"Get Connected"

Good bye 2011 and hello 2012, a perfect time to reinvent yourself if last year wasn’t everything you wanted. For some of us there were simpler times when aspirins, Campho Phenique, or Vicks Salve could cure just about anything with no side effects. Right Bob Garland and Richard Walchle? Now, the side effects from medication are worse than the illness.

I think this is also the case with writing offers, presenting, and getting a call back from a listing agent in today’s Real Estate market. We have more tools available to us than ever. You can tweet me, call me, blog me, fax me, email me……so, where is the APP for these agents? REALLY, just be respectful to my client and myself, let us know something. The challenges for 2012 will be greater than ever so we need to stay “connected,” to fight the fights for the rights of “home ownership”, and the right to stay in the business without banks pushing us out or being taxed out. I believe you need to take this business very seriously, but not yourself.

So look forward to working hard and having a few good belly laughs. I promise no side effects. Anna Pathe, with the help of Lisa Favorite and the Recreation Team, has a fun filled year planned. The first event will be Ice Hockey, get your tickets now. Sherry Baldwin , the Education Chair, has lots of good programs planned to help you take your business to the next level, and Manny De Silvia has scheduled a year of great speakers for you at the Thursday morning TIGAR Breakfast Meetings.

Lastly, I would like to congratulate our REALTOR® of the year, Steve Bussman, Affiliate of the year, John Rigler and Lifetime Achievement Award winner, Kathy Walker. For all this to work, I need you all to get “connected”.

New Laws Affecting REALTORS® for 2012

Last month I reviewed the changes to the existing CAR forms as well as the new forms that our state association created.   In this issue, I will review the new laws which may affect you as California REALTORS.   Unless specified, all new laws will take effect on January 1, 2012.

Disclosures: The Transfer Disclosure Statement has been revised to include a check box in paragraph II. A. where the seller can disclose if water conservation plumbing fixtures have been installed in the property.   Additional text has been added to paragraph II. B. regarding legal requirements of water conservation requirements (Civ. Code 1102.6).   You should now be using the updated TDS form (dated 10-11) in all of your TDS required transactions.   Natural Hazard Disclosure Companies must now disclose whether a property is within one mile of a mining operation (Civ. Code 1103.4).

Homeowners should beware of mortgage modification scams, warns CALIFORNIA ASSOCIATION OF REALTORS®
 Statewide public service announcement campaign to educate homeowners

The CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.) is distributing a public service announcement (PSA) to television and radio stations across California to warn consumers that they are at risk from scammers who offer phony mortgage modification schemes to troubled borrowers. The PSA is designed to allow media outlets to use their recognized talent to alert consumers and will run throughout the holiday season, a time of year that is traditionally high in consumer scam attempts.

 REALTOR® ACTION FUND...Fighting for Our Profession

One of the most important
services organized real estate provides is representation in the halls of government.  REALTOR® Action Fund (RAF) raises money to advance the goals of our REALTOR® political action committees (PACs) at the local, state, and federal levels of government.  RAF supports and/or opposes candidates for elected office who understand, or don't understand, REALTOR® issues. Given California’s ongoing state budget shortfall, 2012 will be another contentious year.  Your support is needed to  preserve C.A.R.’s ability to fight for you! The Association spends $148 per REALTOR® to lobby and advocate for policies helpful to your business. What is this money used for? Over the past few years RAF has:
PRESERVED:  Property Profiles: Title insurance companies stopped providing property profiles in a reaction to a letter issued by the California Department of Insurance. C.A.R. worked to restore access to protect your business.
DEFEATED: 3% Independent Contractor Withholding:  4 times within the past 2 years! Politicians proposed an acceleration of income tax payment in the form of 3% withholding. DEFEATED: Point-of-Sale Bills: Multiple bills were introduced, which if passed, could have resulted in, as much as, $20,000 of costs per home to close escrow.

In this very important election year we all need to help preserve our freedoms and our rights to conduct business. Please participate by contributing the $148 that is spent on your behalf to help protect your business. MLS Director News

David Englin, CRMLS Director Report:

Happy New Year to all our TIGAR members.  I hope you all had a very enjoyable holiday season.  Lot’s going on outside of our business which gives us a welcomed break.

 CRMLS had a quiet December which was a welcomed break for all those involved with MLS.  We had a break in meetings so I don’t have a lot to update you on currently.

We can look forward to the latest version of MATRIX to be released soon.  I understand that there should be some good enhancements to the program.  We also should be seeing new mapping programs and more improvements to Realist.
